This Privacy Policy explains how and what personal data Richemont Fachschule SBC Stiftung and Richemont Dienstleistungs AG (hereinafter referred to as Richemont Fachschule) collects and processes when you visit or use our websites or apps(https://richemontplus.com/, https://richemont.swiss, https://richemont.online, https://richemont-gastro.ch, https://learndoc.swiss, etc.), when you conclude contracts with us or when you deal with us in any other way. Personal data (“data”) means any information relating to an identified or identifiable natural person (the “data subject”). Processing means any handling of personal data regardless of the means and procedures used, in particular the procurement, storage, retention, use, modification, disclosure, archiving, deletion or destruction of data.

2 Processing in the context of business activities
2.1 General information/procurement
We primarily process the personal data that we receive from our customers, suppliers and other business partners as part of our business relationship with them and other persons involved or that we collect from their users when operating our websites, apps and other applications.
In addition to the data that you provide to us directly, the categories of personal data that we receive about you from third parties include in particular
- Information from public registers (e.g. debt collection registers, land registers, commercial registers),
- Information that we obtain in connection with official and court proceedings,
- information in connection with your professional functions and activities (e.g. so that we can conclude and process transactions with your employer with your help),
- information about you in correspondence and meetings with third parties,
- Credit information (insofar as we conduct business with you personally),
- Information about you that people close to you (family, advisors, legal representatives, etc.) give us so that we can conclude or process contracts with you or with your involvement (e.g. references, your address for deliveries, powers of attorney),
- information on compliance with legal requirements such as anti-money laundering and export restrictions),
- Information from banks, insurance companies, sales and other contractual partners of ours regarding claims against you or the provision of services by you (e.g. payments made, purchases made),
- Personal data from the media and the Internet (where appropriate in a specific case, e.g. as part of an application, press review, marketing/sales, etc.), your addresses and, where applicable, interests and other socio-demographic data (for marketing),
- Data in connection with the use of the website (e.g. IP address, MAC address of the smartphone or computer, information about your device and settings, cookies, date and time of the visit, pages and content accessed, functions used, referring website, location data).
2.2 Processing purposes
We use the personal data we collect primarily to fulfill the educational purposes, to protect the interests of our members, to conclude and execute our contracts with our business partners, and to comply with our legal obligations in Switzerland and abroad. If you work for a member or a business partner, your personal data may of course also be affected in this capacity.
In addition, we also process personal data of you and other persons, where permitted and where we deem it appropriate, for the following purposes in which we (and sometimes third parties) have a legitimate interest corresponding to the purpose:
- Offering, ordering, selling our products and services (educational offers, events, digital products, quality management, specialist consultations, etc.); contract processing (incl. billing/payment, delivery);
- Customer account: Users can create a user account. As part of the registration process, users are provided with the required mandatory information. The user accounts are not public and cannot be indexed by search engines, e.g. Google. If users have terminated their user account, their data relating to the user account will be deleted, subject to longer retention periods provided for by law. It is the responsibility of users to back up their data before the end of the contract in the event of termination:
- Testing and further development of our offers, services and websites, apps and other platforms on which we are present;
- Communication and processing of inquiries from you and third parties (e.g. inquiries via contact form, applications, media inquiries)
- Examination and optimization of procedures for needs analysis and collection of personal data for the purpose of member and customer acquisition
- Advertising, publication and marketing (including the organization of events and competitions), provided you have not objected to the use of your data (if we send you advertising as an existing customer, you can object to this at any time and we will then place you on a blacklist against further advertising mailings);
- Newsletter, if you wish to receive the newsletter offered on this website. You can revoke your consent at any time, for example via the “unsubscribe” link in the newsletter.
- Market and opinion research, media monitoring;
- Statistics and analysis of the data collected for the purposes described above. The results may be published; however, no personal data is published.
- Assertion of legal claims and defense in connection with legal disputes and official proceedings;
- Prevention and investigation of criminal offenses and other misconduct (e.g. conducting internal investigations, data analysis to combat fraud);
- Ensuring our operations, in particular IT, our websites, apps and other platforms;
- Video surveillance to safeguard domiciliary rights or security and other measures for IT, building, plant and product security and protection of our employees and other persons and assets belonging to or entrusted to us (such as access controls, visitor lists, network and mail scanners, telephone recordings);
- Transactions under company law and the associated transfer of personal data as well as measures for business management and compliance with legal and regulatory obligations and internal regulations of Richemont Fachschule.
- Further tasks and purposes of use may arise in the event of any changes in the business area of Richemont Fachschule.
If you have given us your consent to process your personal data for specific purposes (for example, when you register to receive newsletters or carry out a background check), we will process your personal data within the scope of and based on this consent, unless we have another legal basis and require one. Consent that has been given can be withdrawn at any time, but this has no effect on data processing that has already taken place.
2.3 Type of personal data collected
The following information about our members, customers, interested parties, suppliers and other contractual partners is typically collected and processed as part of our business activities and for the other processing purposes listed:
- First and last name, address, e-mail, telephone, date of birth/age, gender, family circumstances, AHV number, ID card
- occupation, activity, position;
- Images/photos and video or audio recordings;
- Commercial register data, VAT number, company organization charts, VAT details, contacts;
- particularly sensitive personal data such as data relating to health, privacy (e.g. extracts from the debt collection register);
- Contract data;
- Bank/account data, credit card data, payment data;
- other information to safeguard our rights or fulfill our obligations.
3. further data processing purposes
In addition to the processing purposes described in section 2, we may process your personal data for the following purposes in particular:
- Operation of our website: In order to operate our website securely and stably, we collect technical data, such as IP address, information about the operating system and settings of your end device, the region, the time and type of use. We also use cookies and similar technologies (see also sections 10 and 11).
- Registration: In order to use certain offers and services (e.g. login areas or newsletters), you must register (directly with us or via our external login service providers). For this purpose, we process the data provided during the registration process. We may also collect personal data about you while you are using the offer or service; if necessary, we will provide you with further information about the processing of this data.

- Initiation and conclusion of contracts: With regard to the conclusion of a contract with you or your clients or employers, we may in particular obtain and otherwise process your name, contact details, powers of attorney, declarations of consent, information about third parties, contract contents, date of conclusion, creditworthiness data and all other data that you provide to us or that we collect from third parties (e.g. references, extracts from the debt collection register).
- Administration and processing of contracts: We obtain and process personal data so that we can comply with our contractual obligations towards our contractual partners (e.g. suppliers, service providers, project partners) and, in particular, provide and demand the contractual services. This also includes data processing for the enforcement of contracts (debt collection, legal proceedings, etc.) and accounting. For this purpose, we process the data that we receive or have collected as part of the initiation, conclusion and execution of the contract as well as, for example, data on contractual services and the provision of services and financial and payment information.
- Other purposes: Other purposes include, for example, internal training and education purposes, administrative purposes (e.g. bookkeeping) or the organization of events for the public. We may listen to or record telephone or video conferences for training, evidence and quality assurance purposes. In such cases, we will inform you separately (e.g. by displaying a message during the video conference in question) and you are free to inform us if you do not wish to be recorded or to terminate the communication (if you simply do not wish your image to be recorded, please turn off your camera). 4 Categories of data recipients
Within the scope of our activities and processing purposes, the personal data collected may be passed on to the following bodies (companies, legally independent organizational units or persons who process this data on their own responsibility) in compliance with data protection or a legal basis:
- Service providers in Switzerland and abroad who process data (i) on our behalf, (ii) under joint responsibility with us or (iii) under their own responsibility that they have received from us or collected for us. These service providers include, for example, IT providers, advertising service providers, other service or content providers, banks, insurance companies, debt collection agencies, credit agencies, address verifiers, consulting firms or lawyers. We generally enter into contracts with these third parties regarding the use and protection of personal data.
- Dealers, suppliers, subcontractors and other business partners;
- Members;
- The public, media, visitors to websites and social media;
- Competitors, industry organizations, associations, organizations and other bodies;
- Courts and authorities;

- other persons: This refers to other cases where the involvement of third parties arises from the processing purposes. This concerns, for example, delivery addressees or payment recipients specified by you, third parties in the context of representative relationships (e.g. your lawyer, trustee or your bank).
5. disclosure abroad
We process and store personal data mainly in Switzerland and the European Economic Area (EEA), but also in any country in the world in accordance with legal requirements.
If a recipient is located in a country without adequate data protection, we contractually oblige the recipient to comply with an adequate level of data protection (we use the revised standard contractual clauses of the European Commission, which are available at LINK; including the supplements required for Switzerland), unless the recipient is already subject to a legally recognized set of rules to ensure data protection and we cannot rely on an exemption provision. An exception may apply in particular in the case of legal proceedings abroad, but also in cases of overriding public interests, if the execution of a contract that is in your interest requires such disclosure (e.g, if we disclose data to our correspondence offices), if you have given your consent, or if it is not possible to obtain your consent within a reasonable period of time and the disclosure is necessary to protect your life or physical integrity or that of a third party, or if the data in question has been made generally accessible by you and you have not objected to its processing.
6 Storage of personal data
The personal data will be processed and stored – taking into account the legal requirements – for as long as is necessary for the fulfillment of contractual or legal obligations or otherwise for the purposes pursued with the processing.
7 Right to information and other rights of data subjects
Each and every data subject within the meaning of the FADP may request information about the personal data concerning them within the framework of the applicable data protection law. The right to information may also include the purpose of processing, the storage period and the origin of this personal data. The deletion and blocking of the forwarding of data can also be requested in principle, but it should be noted that the Richemont Fachschule may not be able to comply with such a request based on its legal obligations or overriding interests, depending on the situation. The identity of the data subject will be verified in all cases, for example by means of a copy of an identity document or the AHV number.
8 Data security
We take appropriate technical and organizational measures in accordance with the legal requirements, taking into account the state of the art, the implementation costs and the nature, scope, circumstances and purposes of the processing as well as the different probabilities of occurrence and the extent of the threat to the rights and freedoms of natural persons, in order to ensure a level of protection appropriate to the risk. The aforementioned protection of personal data against unauthorized access and misuse is promoted by issuing directives, training, IT and network security solutions, access controls and restrictions, encryption of data carriers and transmissions, pseudonymization and controls. Absolute security cannot be guaranteed, especially when using the Internet.
Measures include, in particular, ensuring the confidentiality, integrity and availability of data by controlling physical and electronic access to the data as well as the access, input, transmission, availability and separation of the data.
SSL/TLS encryption: Our website uses SSL/TLS encryption for security reasons and to protect the transmission of confidential content, such as the requests you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.

The data processed by the payment service providers includes inventory data, such as the name and address, bank data, such as account numbers or credit card numbers, passwords, TANs and checksums, as well as contract, total and recipient-related information. The information is required to carry out the transactions. However, the data entered is only processed by the payment service providers and stored by them. As the operator, we do not receive any information about the (bank) account or credit card, but only information to confirm (accept) or reject the payment. Under certain circumstances, the data may be transmitted by the payment service providers to credit agencies. The purpose of this transmission is to check identity and creditworthiness. 10 Cookies / tracking and other technologies in connection with the use of our website
When using our website (including newsletters and other digital offers), data is generated that is stored in logs (in particular technical data). We may also use cookies and similar technologies (e.g. pixel tags or fingerprints) to recognize website visitors, evaluate their behavior and identify preferences. We can use the statistics obtained to improve our offer and make it more interesting for you as a user. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. As a result, IP addresses are further processed in abbreviated form, so that they cannot be linked to a specific person. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. Our website uses Google Conversion Tracking. If you have reached our website via an advertisement placed by Google, Google Ads will set a cookie on your computer. The cookie for conversion tracking is set when a user clicks on an ad placed by Google. These cookies lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of our website and the cookie has not yet expired, we and Google can recognize that the user clicked on the ad and was redirected to this page. Each Google Ads customer receives a different cookie. Cookies can therefore not be tracked via the websites of Ads customers.
